Citing politics, attorneys says Carter judge should recuse herself

WEST CHESTER — The attorney for a man whose long-running dispute with a neighbor ended with him fatally shooting the man outside their West Goshen homes wants the Common Pleas Court judge set to oversee his trial to step aside from the case, citing her possible elevation to the federal bench. In the motion, which Wheatcraft heard in court on Wednesday, Green said that the case against Carter was likely to include suggestions that Carter had shot his neighbor, G. Brooks Jennings, for political reasons. Jennings was a Republican committeeman in the township, and Carter, at the time of the shooting, had several anti-Trump signs in his front yard, months after the presidential election. Green said the political nature of the case had been “widely covered” in the local and national media, citing one post on the internet titled, “Democrat Clayton Carter Murders Chesco GOP Committeeman Brooks Jennings.” He stated that the prosecution intended to bring up the political differences of the two men as the cause of the conflict between the two. Whatever differences over local or national politics may have existed between Carter and Jennings, “that is one of the many things the victim and the defendant argued over. The defendant and victim were next-door neighbors. An argument apparently erupted between the two men over a spotlight that Jennings had trained on his own car, parked in front of Carter’s house. Carter acknowledged to police in a later interview that he had shot Jennings, but said it was because Jennings had threatened him with a knife that was found at the scene. Evidence that may come out at the trial was discussed during the pre-trial hearing before Wheatcraft on Wednesday. Ost-Prisco acknowledged that medical reports showed that Jennings had been intoxicated, but questioned whether evidence of his drinking earlier should be permitted.

Drama grips court as Manafort lawyers accuse Rick Gates of multiple affairs

Defence lawyers for Paul Manafort made a last-ditch attempt on Wednesday to torpedo the key witness at his trial by asking whether he failed to disclose four extramarital affairs. Manafort and Gates were the first two individuals indicted in Mueller’s investigation into potential collusion between Russia and the Trump campaign. Andres put it to him: “As you sit here today, do you have any doubt that if you lie, the special counsel’s office will rip up your plea agreement?” Gates said he did not. “You said you had a made mistake,” the lawyer said. Relevance.” Downing responded that the question goes to whether Gates told the truth to the special counsel or whether the plea agreement should be ripped up – potentially devastating to the government’s case and to the public perception of special counsel Robert Mueller’s investigation into Russian election interference. After about five minutes, the judge and lawyers returned to their positions, and Downing appeared to have lost the battle. He asked a broader question about Gates spending beyond his means to fund a secret life. On Wednesday, Gates initially testified Manafort told him to be truthful during a 2014 interview with the FBI about offshore shell companies and bank accounts that contained millions of dollars in proceeds from their Ukrainian political work. Gates and Manafort were not targets of the FBI at the time of the interview. “You knowingly made a false statement to the FBI?” Andres asked on Wednesday.

Trump lawyers to Mueller: Trump cannot be forced to testify – report

Donald Trump’s lawyers sent a private 20-page letter to the special counsel Robert Mueller to assert that he cannot be forced to testify in the investigation into Russian meddling in the 2016 election, according to a report. The memo is an assertion of presidential power and another front on which Trump’s lawyers have argued that he cannot be subpoenaed. In the letter, the legal team argues that a charge of illegal obstruction is moot because the US constitution empowers the president to, “if he wished, terminate the inquiry, or even exercise his power to pardon”. Donald Trump accuses Mueller team of 'meddling' in midterm elections Read more In the letter, according to the New York Times, the president’s legal team write: “It is our understanding that the reason behind the request for the interview is to allow the special counsel’s office to complete its report. “After reviewing the list of topics you presented, it is abundantly clear ... that all of the answers to your inquiries are contained in the exhibits and testimony that have already been voluntarily provided to you .... all of which clearly show that there was no collusion with Russia, and that no FBI investigation was or even could have been obstructed. Donald J. Trump (@realDonaldTrump) There was No Collusion with Russia (except by the Democrats). When will this very expensive Witch Hunt Hoax ever end? So bad for our Country.
